Enforcement

Any formal decision or action taken by NOPSEMA or an OHS inspector to maintain or restore compliance, or to prevent or respond to non-compliance, by a duty holder in relation to the listed OHS laws. Enforcement therefore includes: reporting breaches of legislation to the Director of Public Prosecutions; issuing prohibition and improvement notices; making recommendations in a report of an inspection; deciding the acceptability of a submitted safety case; requiring validation; or giving a warning, written or verbal, concerning an OHS matter.
